第10回優秀賞unanimous basis. 17By utilising the ICJ’s function in providing legal advice ? whichdoes not require consent of parties involved ? the U.N. can clarify legal ambiguitiesand contribute to the establishment of a firmer basis for the international morality.Through more frequent use of Article 96 of the Charter, therefore, the ICJ canbecome a guiding torch for the international norms and morality.2.Regional LevelSimilarly, regional mechanisms such as the European Court of Human Rights andInter-American Court of Human Rights have the competence in providing advisoryopinions and their work would, too, enhance the significance of the internationalmorality. Also pertinent to regional arrangements are the existence of human rightsinstruments upheld by regional organisations such as the European Convention forthe Protection of Human Rights(Council of Europe), the American Convention onHuman Rights(OAS)and the African Charter on Human and People’s Rights(OAU).These legal instruments should be utilised in promotion and protection of humanrights so as to create an environment for real peace.3.National LevelAwareness-building activities are also essential at the national level. National NGOsin close collaboration with international NGOs will become the focal point of theseactivities, given their expertise and familiarity with local situations. If the nationallegal system is still in tact and functional, lawyers and academics in collaboration withcitizens groups and NGOs should be more actively involved in bringing any peacethreateninghuman rights violations to the domestic court of law. In doing so, thecompetence and impartiality of the domestic judiciary system would be kept in check.4.Individual LevelIndividuals are also required to be active participants in forming the normative17 Louis Henkin, Richard C.
